Terms and Conditions of Sale

These terms apply when you purchase photographs, prints, digital images, videos, reels or other products from Action Replay Photography Ltd.

Please read them before placing an order. They explain what you can expect from us, what we need from you and how you may use the photographs and videos you purchase.

Nothing in these terms removes or limits your legal rights as a consumer.

1. About Us

In these terms:

  • “we”, “us” and “our” mean Action Replay Photography Ltd;
  • “you” and “your” mean the person placing the order;
  • “website” means the Action Replay Photography website and its associated galleries;
  • “digital content” includes JPEGs, videos, reels and other downloadable files.

2. Products Covered by These Terms

We sell products including:

  • professional photographic prints;
  • Social Media JPEGs;
  • High-Resolution JPEGs;
  • All Images Deals;
  • full-round cross-country videos;
  • social reels;
  • the All Action Package;
  • mounts and other related products.

The description, price and contents of each product will be shown on the relevant event page, product page or checkout page.

Please read the product description carefully before ordering.

3. Event Coverage and Availability

We make every reasonable effort to photograph and film competitors at the events we attend. However, we cannot guarantee that we will capture:

  • every competitor;
  • every phase or obstacle;
  • every part of a round;
  • a particular pose, angle or moment;
  • a specific number of photographs or video clips.

Coverage may be affected by weather, lighting, course layout, event restrictions, equipment failure, competitor withdrawal, elimination, changes to the running order or other circumstances outside our reasonable control.

A product is only available if suitable photographs or footage have been captured.

If you purchase a product that we are subsequently unable to supply, we will offer a suitable alternative where possible or refund the amount paid for that product.

4. Preview Images and Videos

Website and viewing-station previews are intended to help you select your products.

Preview images may:

  • be unedited or batch processed;
  • appear lighter or darker than the final image;
  • require cropping or colour correction;
  • contain temporary watermarks;
  • be displayed at a lower resolution than the purchased product.

Computer screens and mobile devices display colours and brightness differently. A printed photograph may therefore look slightly different from the image displayed on your screen.

These normal differences are not faults unless the finished product is materially different from its description or falls below a reasonable quality standard.

5. Placing an Order

Please check your order carefully before paying.

You are responsible for checking:

  • the event;
  • the competitor folder;
  • the horse and rider;
  • the selected photograph or video;
  • the product type;
  • the print size;
  • the delivery address;
  • the email address.

We provide an opportunity to review your order before payment.

Your order is an offer to purchase the selected products. A contract is formed when we accept payment and send your order confirmation.

If there is an obvious pricing error, technical error or product-availability problem, we may contact you to correct the order. You may accept the correction or cancel the affected item for a full refund.

6. Choosing the Correct Image or Video

Please make sure that you have selected the correct image, competitor or video before completing your order.

Contact us immediately if you notice a mistake.

Where work has not started, we will make reasonable efforts to correct or cancel the order.

Once a print has entered production, digital editing has begun or digital content has been supplied, we may be unable to change an incorrectly selected item.

This does not affect your rights if we supply the wrong item or if the product is faulty or not as described.

7. Prices, Offers and Payment

The price payable is the price shown when you place your order.

Prices include VAT where applicable. Delivery charges and any optional extras will be shown before you pay.

Payment must be received before we begin processing your order.

Event discounts and promotional offers:

  • are available only during the dates and times stated;
  • may apply only to specified events or products;
  • cannot normally be combined with another offer unless we say otherwise;
  • end automatically at the stated deadline.

Free mounts, free event names or other promotional extras are only included where this is clearly stated on the event or product page.

An expired offer does not apply simply because the photographs were taken during the offer period. The order must be completed before the stated deadline.

8. Print Sizes, Mounts and Packaging

The print size and any included mount will be described when you order.

Unless otherwise stated:

  • 6 × 9-inch prints may include a mount during the event discount period;
  • mounts may be available as a paid extra outside the discount period;
  • 12 × 8-inch mounts are not normally available for postal orders;
  • mounts may be available at selected click-and-collect events;
  • event names are included only where stated.

Postal prints are packaged using protective board-backed or similarly suitable packaging.

Larger prints may be produced and dispatched directly by a professional photographic laboratory.

9. Image Cropping and Print Ratios

Different print sizes use different proportions.

A photograph shown online may therefore need to be cropped differently when printed at another size. This can result in slightly more or less background appearing around the horse and rider.

We will use our professional judgement to create an appropriate crop.

Please contact us before ordering if you require:

  • a particular crop;
  • additional background;
  • black-and-white processing;
  • removal of a specific background distraction;
  • another special edit.

Changes requested after a product has been produced may require a new order and additional payment.

10. Image Quality and Event Conditions

Equestrian and sporting events often involve difficult photographic conditions.

Indoor photography

Indoor photographs may contain some visible grain or digital noise because higher camera sensitivity may be required to photograph fast action in low light.

Artificial lighting may also affect colour. We will make reasonable adjustments, but an exact colour match may not always be possible.

Outdoor photography

Rain, mist, spray, mud, shadows, bright sunlight and changing weather may be visible in photographs or video footage.

Fast-moving action

Some motion blur may be present in action photographs. Where this is visible in the preview and does not materially spoil the photograph, it is not normally considered a production fault.

We may contact you before printing if we identify a significant technical issue. However, because we capture many thousands of images at some events, we cannot promise to identify every issue before an order is placed.

We will not normally offer a refund solely because you later dislike a pose, expression, composition or moment that was clearly visible in the preview.

Your legal rights still apply where the final product is faulty, materially different from the preview or description, or below the standard a reasonable customer would expect.

11. Processing and Delivery Times

The estimated processing time will normally be shown on the relevant event or product page.

Unless otherwise stated, we aim to process orders within 10 working days.

A working day is Monday to Friday, excluding UK bank holidays.

During particularly busy periods, holidays, severe weather, technical problems or other unusual circumstances, an order may take longer. In exceptional circumstances, processing may take up to 28 days.

We will contact you if there is likely to be a substantial delay.

Please tell us before ordering if you need a product by a particular date. We cannot guarantee a deadline unless we have expressly agreed to it in writing.

12. Delivery of Digital Products

Digital products may be delivered by:

  • email;
  • a download link;
  • Google Drive;

Please check your spam or junk folder if the delivery email does not appear in your inbox.

You are responsible for providing a correct and accessible email address.

Download links may remain active for a limited period. Unless we tell you otherwise, you should download and securely back up your files within 28 days.

We do not guarantee that download links or edited files will remain available indefinitely.

If you ask us to recreate and re-upload an expired order, we may treat this as a new order and charge a reasonable fee for the additional editing, administration and upload work. We will tell you the cost before beginning.

13. Delivery of Physical Products

UK print orders are normally sent through Royal Mail or another suitable delivery provider.

The estimated delivery time is not guaranteed unless we expressly agree to a guaranteed service.

We remain responsible for the goods until they are delivered to:

  • you;
  • a person you nominate; or
  • a safe place or collection point you have expressly authorised.

Please contact us if an order has not arrived within the expected period.

We may ask you to:

  • check with members of your household;
  • check with neighbours;
  • check any nominated safe place;
  • contact your local delivery office;
  • confirm your delivery address.

We will investigate the missing delivery with the carrier. Where the order is confirmed lost, we will provide an appropriate replacement or refund in accordance with your legal rights.

14. Incorrect Addresses and Uncollected Orders

You are responsible for entering the correct delivery address.

If an order is returned because:

  • the address you supplied was incorrect or incomplete;
  • delivery was refused;
  • the item was not collected from the delivery office;
  • you failed to follow the carrier’s delivery instructions,

we may charge you the reasonable cost of re-packaging and re-delivery.

We will tell you the amount before sending the order again. The charge will reflect the actual postage, packaging and handling involved.

This section does not apply where the return was caused by our mistake or the delivery provider’s failure.

15. International Orders

Please contact us before ordering prints for delivery outside the UK.

Additional postage, packaging, customs charges, import taxes or local fees may apply.

We will tell you our international delivery charge before processing the order. If you do not accept the additional charge, we may cancel the physical product and refund the amount paid for it.

You are responsible for any customs duties or import taxes charged by the destination country.

International delivery times vary and may be affected by customs procedures or local postal services.

We normally recommend digital products for international customers because they can be delivered more quickly and without international postage charges.

16. Cancelling an Order

Your cancellation rights depend on the type of product ordered.

Standard physical products

For physical goods that are not personalised or made to order, you normally have 14 days from receiving the goods to tell us that you wish to cancel.

You then have a further 14 days to return them.

You are normally responsible for the return postage unless the item is faulty, damaged or incorrect.

Made-to-order and personalised prints

Our photographic prints are normally produced to order using the particular image, size, crop and o you select.

Because these products are made to your specifications, you do not normally have a change-of-mind right to cancel after production has started.

Contact us immediately if you want to cancel. If production has not begun, we will normally cancel the order and refund you.

This does not affect your rights if the print is faulty, damaged, incorrect or not as described.

Digital images and downloadable content

You normally have a 14-day cancellation period for online digital-content contracts.

However, you may ask us to supply your digital content during this period.

Where immediate or early supply is requested, we will ask you to:

  • expressly agree that supply may begin during the cancellation period; and
  • acknowledge that you will lose your right to cancel once supply of the digital content begins.

Your right to cancel because you changed your mind will then end when supply begins.

Your rights remain unaffected if the digital content is faulty, not as described or cannot be supplied.

Video and reel editing services

A full-round video, reel or similar product may involve both an editing service and the supply of a finished digital file.

If you ask us to begin editing during the 14-day cancellation period and then cancel before the work is completed, we may charge a reasonable amount for work already carried out.

If the service has been completed after you expressly asked us to begin early and acknowledged the effect on your cancellation rights, you may lose the right to cancel because you have changed your mind.

We will not charge more than a proportionate amount for work actually completed.

17. Faulty, Damaged or Incorrect Products

Please contact us as soon as possible if a product is:

  • damaged;
  • faulty;
  • not as described;
  • incorrectly produced;
  • significantly different from the product ordered;
  • unsuitable because of a production error;
  • not delivered.

We may ask for photographs showing damage or a printing problem so that we can assess the issue without requiring an immediate return.

Depending on the circumstances and your legal rights, we may offer:

  • a replacement;
  • repeat performance of an editing service;
  • repair or correction of digital content;
  • a price reduction;
  • a partial refund;
  • a full refund.

We will not charge you for returning a product that is confirmed to be faulty, damaged or incorrect.

18. Change-of-Mind Returns

We do not normally accept change-of-mind returns for:

  • made-to-order photographic prints;
  • personalised products;
  • completed editing services;
  • digital images after supply has begun with your express agreement;
  • downloaded videos or reels after supply has begun with your 

This does not remove your rights when a product is faulty, damaged, incorrect or not as described.

19. Copyright Ownership

Action Replay Photography Ltd retains the copyright in the photographs, images, videos, reels and other creative work we produce, unless we expressly agree otherwise in writing.

When you purchase a print, you own that physical copy of the print.

When you purchase a digital file, you own the supplied copy of that file.

Purchasing a print or file does not transfer the copyright to you.

Instead, you receive permission to use the product in the ways described below.

20. Personal-Use Licence

Unless we agree otherwise in writing, your purchase gives you a personal, non-exclusive and non-transferable licence.

This means that you may use the product for the permitted personal purposes, but you may not sell, license or commercially exploit our work.

Social Media JPEG

A Social Media JPEG may normally be used:

  • on your personal social-media accounts;
  • on your personal website;
  • in an online or printed advert selling the horse or pony shown.

A Social Media JPEG may not normally be:

  • used to produce prints or canvases;
  • supplied for magazine or newspaper publication;
  • used by a sponsor, brand or business;
  • used in commercial advertising;
  • used to promote products or services;
  • resold or licensed to another person.

High-Resolution JPEG

A High-Resolution JPEG may normally be used:

  • to produce prints or canvases for your personal use;
  • on your personal social-media accounts;
  • on your personal website;
  • in an advert selling the horse or pony shown.

A High-Resolution JPEG may be submitted to a magazine or newspaper for editorial consideration, but you or the publication must obtain our written permission before publication.

Commercial, promotional and sponsored use requires a separate licence.

All Images Deal

Images included in an All Images Deal are supplied under the same personal-use licence as our High-Resolution JPEGs.

The photographs are normally batch edited rather than individually edited and cropped.

Social reels

You may upload a purchased social reel, as supplied, to your personal social-media accounts.

You must not remove our branding, sell the reel, license it to another person or use it for commercial promotion without written permission.

Full-round videos

You may use your purchased full-round video for personal viewing and permitted personal sharing.

You must not upload a full-round video to YouTube or another public video library or channel without our written permission.

You may post it as supplied to a personal social-media feed where we have indicated that this is permitted.

21. Uses That Are Not Permitted

Unless we give written permission, you must not:

  • scan, photograph or otherwise copy one of our prints;
  • take screenshots from our videos or reels;
  • make screen recordings of our videos or reels;
  • remove or conceal a logo, watermark, credit or copyright notice;
  • add filters or make substantial colour changes;
  • crop, chop, shorten or re-edit a video;
  • use part of a video to create another video;
  • combine our photograph or video with other material to create a montage;
  • use artificial intelligence to alter or recreate our work;
  • sell or sublicense our work;
  • supply the file to a business, sponsor or commercial organisation;
  • use the work for merchandise, advertising or business promotion;
  • claim that you or someone else created the work.

Normal resizing or compression carried out automatically by a social-media platform is not treated as an unauthorised alteration.

You may share a purchased product with the rider or horse owner for the same permitted personal use, but you remain responsible for explaining these restrictions to them.

22. Publications and Commercial Use

Businesses, sponsors, brands, magazines, newspapers, publishers, event organisers, breed societies and other organisations must contact us for permission before using our work.

Please tell us:

  • which image or video you want to use;
  • where it will appear;
  • the size and position;
  • the publication or campaign;
  • the length of use;
  • the countries in which it will be used;
  • whether it will be used in print, online, advertising or social media.

We will provide a quotation or written licence where appropriate.

Unless agreed otherwise, published photographs must be credited:

We do not normally supply photographs in exchange for advertising, exposure, free products or services.

Buying a print does not include a digital file or publication licence. These are separate products and permissions.

23. Unauthorised Use

If we discover that our photograph, video or reel has been used without permission, we may:

  • ask for the use to stop;
  • request removal of the content;
  • ask for details of where and how it has been used;
  • offer an appropriate retrospective licence;
  • seek payment reflecting the type, extent and duration of the unauthorised use;
  • take legal action where necessary.

Any amount claimed will be based on the circumstances of the use and the remedies available under copyright and contract law.

We will normally try to resolve the matter directly before beginning legal proceedings.

24. Storage of Photographs and Footage

We do not promise to store photographs, footage, edited products or customer downloads indefinitely.

Unless we have expressly agreed otherwise in writing, we have no storage contract with:

  • an individual competitor;
  • a customer;
  • an event organiser;
  • a venue;
  • a governing body.

Photographs and footage may be removed because of storage limits, technical failure, file corruption, equipment damage or changes to our archive.

You should purchase any required products while they remain available.

After receiving a digital product, you are responsible for downloading it and keeping secure backup copies.

If we lose the files before fulfilling a paid order and cannot provide a suitable replacement, we will refund the affected product.

25. Customer Information and Privacy

We use customer information to:

  • process payments;
  • prepare orders;
  • deliver prints and digital products;
  • communicate about orders;
  • prevent fraud;
  • keep appropriate business and tax records;
  • deal with complaints and legal claims.

We may share necessary information with organisations that help us fulfil an order, including:

  • payment providers;
  • photographic laboratories;
  • website and gallery providers;
  • cloud-storage and file-transfer services;
  • postal and delivery companies;
  • IT service providers.

We only provide the information reasonably required for them to perform their service.

26. Our Responsibility to You

We are responsible for losses that are a foreseeable result of:

  • our breach of these terms;
  • our failure to use reasonable care and skill;
  • supplying faulty or misdescribed products;
  • our negligence.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Products purchased under these consumer terms are intended mainly for personal use. We are not responsible for business losses, lost profits, lost sponsorship, lost advertising opportunities or loss of commercial income unless we expressly agreed to a commercial contract covering those losses.

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • a legal right that cannot lawfully be excluded;
  • any other liability that the law does not allow us to exclude.

27. Events Outside Our Control

We are not responsible for delays caused by circumstances outside our reasonable control, including:

  • severe weather;
  • flooding;
  • fire;
  • power or internet failure;
  • postal disruption;
  • transport disruption;
  • event cancellation;
  • restrictions imposed by an event organiser;
  • serious illness;
  • failure of third-party systems;
  • widespread technical outages.

We will take reasonable steps to reduce the effect of the delay and will contact you where appropriate.

If a substantial delay means that we cannot fulfil your order, you may be entitled to cancel the affected product and receive a refund.

28. Complaints

We will investigate and aim to respond within a reasonable time.

Making a complaint does not affect your legal rights.

29. Changes to These Terms

We may update these terms when our products, delivery methods or legal obligations change.

The terms that apply to your order are the version made available to you when you place that order.

A later change will not retrospectively alter an existing order unless the change benefits you or is required by law.

30. If Part of These Terms Is Invalid

If a court or other competent authority finds that part of these terms is invalid or unenforceable, the remaining terms will continue to apply.

31. Law and Courts

These terms are governed by the law of England and Wales.

If you live in Scotland or Northern Ireland, you retain any mandatory consumer protections that apply where you live and may normally bring proceedings in your local courts.

Sign up for occasional emails on product updates and sales. Typically we will send out on to two emails per week maximum.
Your information is safe with us and will be only be shared to create products that you have ordered that are made by a third party i.e. Our A3 prints are produced by a reputable lab. As they ship directly to you they require your name and address. Under Action replay photography we also have a brand Steve's Portrait Emporium. We may email you regarding products or promotions for this part of Action replay Photography Ltd.
